The Service is intended for licensed healthcare providers. By using the Service, you represent that you are a licensed medical professional authorised to practise in your jurisdiction.
4. Provider Responsibilities
4.1 Clinical Oversight
- AI-generated notes are drafts. Providers must review, edit, and approve all notes before they become part of the medical record.
- Providers are solely responsible for the accuracy of finalised clinical documentation.
- The minimum review period for note approval is a safeguard, not a guarantee of adequate review.
4.2 Patient Consent
- Providers must obtain patient consent before recording any clinical encounter.
- Consent must be documented through the platform's consent recording system.
- Providers must inform patients about the use of AI in generating clinical notes.
4.3 Account Security
- Providers are responsible for maintaining the security of their account credentials.
- Any unauthorised use must be reported immediately.
5. Intellectual Property
- The CARIVIVA platform, including its software, algorithms, and design, is owned by CARIVIVA.
- Clinical content (notes, transcripts) generated through the Service belongs to the healthcare provider/organisation.
6. Disclaimers
- The Service is provided "as is" without warranties of any kind.
- AI-generated content may contain errors. The Service does not replace clinical judgement.
- CARIVIVA is not responsible for clinical decisions made based on AI-generated content.
7. Limitation of Liability
CARIVIVA shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Service.
8. Data and Privacy
Use of the Service is also governed by our Privacy Policy. By using the Service, you agree to the collection and use of information as described in the Privacy Policy.
9. Modifications
We reserve the right to modify these Terms at any time. Continued use of the Service after modifications constitutes acceptance of the updated Terms.
